Lottery terms and conditions

 

1.    Introduction

1.1.        The Blind Veterans UK weekly lottery (“the Lottery”) is being promoted by Blind Veterans UK, a Charity registered in England and Wales with registration number 216227 and in Scotland with registration number SC039411, and company registration number 00189648 (“The Society”).

1.2.        Blind Veterans UK is licenced and regulated in Great Britain by the Gambling Commission under account number: 008297.

1.3.        The registered Responsible Person for the Lottery is Claire Rowcliffe, Blind Veterans UK, 3 Queen Square, London WC1N 3AR.

1.4.        The Society is assisted in operating its lottery by an External Lottery Manager ("the ELM"), The Woods Group Limited of Lansdowne House, Bumpers Way, Chippenham SN14 6NG, licensed and regulated in Great Britain by the Gambling Commission under account number 3586.

1.5.      The Lottery is subject to the laws of England and Wales.  

1.6.      Based on the average number of Chances in the weekly lottery draw in the last 12 months, the likelihood of winning a prize is a 1 in 320 chance.  For Superdraws, the likelihood of winning a prize is 1 in 6,900 chance.

1.7.      In the period April 2023 to March 2024 lottery proceeds were spent as follows:

·         12% of the proceeds is spent on prizes

·         9% of the proceeds is spent on expenses related to the promotion and running of the lottery.

·         79% of the proceeds is applied directly to the purposes of the society from all tickets sold.

1.8.      These Terms and Conditions are the Lottery Rules, by entering the Lottery, players agree to be bound by these Terms and Conditions.

2.    Definitions

·         Chance: Each individual Player’s Numbers entered into the Lottery.

·         Player: An individual who has registered to play the Lottery.

·         Player’s Number: The system generated number used to identify a Player’s individual Chance entered into the Lottery.

·         Responsible Person: The individual within the Society who is licensed by the Gambling Commission to perform the functions in connection with:

a)       the provision of facilities for gambling, or

b)      a person who provides facilities for gambling.

3.    Entry

3.1.      The Lottery is open to residents of England, Wales, and Scotland only. Residents from outside of these territories are not permitted to enter. 

3.2.      Underage gambling is an offence and legally players must be aged 16 or over to enter a lottery.  

3.3.      The rules for the Lottery require entrants to be over the age of 18.

3.4.      Players will be required to provide the DOB and affirm that they are over the age of 18 when entering via the website or via telephone.  

3.5.      The Society and/or the ELM reserves the right to require proof of identity and age.

3.6.      Any Player who has entered and/or participated in the Lottery who is subsequently found to be underage will:

a)       Be excluded from any future draws.

b)      Receive a refund for all monies paid, minus any prizes already paid out. 

c)       Have their Direct Debit cancelled.

d)      Not receive any prizes that might have been due to them, and if prizes have already been paid out, all reasonable attempts will be made to recover them if the amount in clause 3.6 b) is not sufficient.

3.7.      Players are not permitted to purchase Chances on behalf of any other person.

3.8.      The cost of each Chance is £1 per week and payment must be received and cleared before entry to the weekly draw.

3.9.      Players can sign up to a maximum of 5 Chances per week.

3.10.  Payment for Chances via the website and telephone must be made by Direct Debit.

3.11.  Payment via post can be made via cheque.

3.12.  Payment by Direct Debit can be monthly, quarterly, six monthly or annual.

3.13.  If paying by Direct Debit payment of £4 or £5 per, or multiples of these amounts if you have more than once chance, will be collected directly from your bank account.  The payment amount will be dependent on the number of draws in between your payment dates, this will enable entries to be made into every draw.

3.14.  Payments will be referenced as BLIND VETERANS on your bank statement.

3.15.  A unique system generated Player Number will be assigned for each Chance purchased.

3.16.  Where a Player requests to upgrade or downgrade the number of Chances this will come into effect at the next scheduled payment date.

3.17.  The Society and/or the ELM at their sole discretion may refuse to accept an entry for an individual to become a Player of the Lottery.

3.18.  You will be sent a confirmation email of your entry to the Lottery, your Player Number(s), and if applicable your Direct Debit advance notification letter (ANLs).  Postal confirmation will only be sent where no email address has been provided, or an email has been rejected.

3.19.  It is the Player’s responsibility to ensure that their personal information provided is accurate and the Society and/or the ELM cannot be held liable for any error.

3.20.  The Society’s staff working within Engagement, Finance and SLT, as well as the Responsible Person(s) are prohibited from playing the Lottery.  Immediate family and those living with these excluded individuals are also not permitted to participate in the Lottery.

3.21.  External agents involved in the production or promotion of the Lottery, or selling lottery tickets face-to-face for specific daws are not permitted to enter those draws. 

3.22.  All employees of the ELM are excluded from playing the Lottery.

4.    Administration

4.1.      If you discover an error in your name, address or any other details provided to us as part of your sign-up when you receive your confirmation then please log on via ‘My Account’ or telephone 0330 002 0285.  Any required corrections will be made as soon as reasonably possible.

4.2.      Neither the Society and/or the ELM shall be liable for any loss or damage, including not being entered into the Lottery and / or the right to receive a prize, suffered by a Player until such correction has been made.

4.3.      Chances will be entered into the first available Draw 4 working days after the Direct Debit collection has been made from your bank account.

4.4.      You may cancel your entry to the Lottery by telephoning 0330 002 0285.  Future direct debit payments will be cancelled within 3 working days.

4.5.      The Society and/or the ELM may at its absolute discretion suspend the Lottery for any period of time. During such period, the ELM/Society shall:

a)       Suspend Direct Debit payments from your bank or building society account as soon as reasonably practicable, and;

b)      Retain any amounts which were paid prior to such suspension taking effect that have not been used to pay for Chances in previous Draws.

4.6.      You will be notified of further details regarding the resumption of the lottery or otherwise as soon as reasonably practicable after the date of suspension in writing.

4.7.      The Society and/or the ELM may cancel your entry into the Lottery at any time.  You will be notified accordingly as soon as reasonably practicable and will be reimbursed any amounts which have been paid but which relate to future draws.

4.8.      Other than the reimbursement of any such amounts, neither the Society and/or the ELM shall be liable for any loss or damage, including not being entered into the Lottery and / or the right to receive a prize, suffered by a Player in relation to such cancellation.

4.9.      The Society may amend these terms and conditions at any time; any significant changes to these terms and conditions will be communicated via this website.

5.    The Draw

5.1.      The Lottery draw will take place every Friday.  

5.2.      Four times a year the weekly lottery draw will be combined with the Blind Veterans UK raffle draw in a Superdraw; this is not an additional draw for the Lottery. 

5.3.      The draws are conducted by the ELM, who use a random number generator (RNG), tested and approved by a Gambling Commission certified test house.

5.4.      Prizes will be drawn in order, the first prize will be drawn first, second prize second, third prizes next and so on until all prizes have been allocated.

5.5.      Winners will be notified by either post, email, or telephone within 7 days.

5.6.      A list of the winning ticket numbers, initial, surname and town of winners’ will be published on the website e.g. J Bloggs from Swindon. 

5.7.      There are no alternatives to the cash prizes and no interest is payable.

5.8.      Prizes will be paid by cheque within 28 days.

5.9.      Any prize not claimed or banked within 6 months of the draw will be forfeited and treated as a donation to the Society.

5.10.  Prizes will be paid out to a deceased Player’s estate if the person claiming can prove, to the Society’s / the ELM’s reasonable satisfaction, that they are entitled to make the claim on behalf of the estate.

5.11.  The Socety’s / the ELM’s decision on all matters affecting the draw is final and legally binding, no correspondence regarding the results of the draw will be entered into. 

6.    Prizes

6.1.      The prizes for the Lottery are:

·         1st prize – 1000.00

·         2nd prize – 100.00

·         2 x 3rd prize – £50.00

·         30 x 4th prize £10.00 M&S Voucher

6.2.      The Prizes for the Superdraw are:

·         1st prize – 15000.00

·         2nd prize – 1000.00

·         3rd prize – 100.00

·         2 x 4th prize £50

·         30 x 5th prize £10.00 M&S Voucher

7.    Liability

7.1.      The Society or the ELM shall not be liable for any loss or damage suffered by you arising from:

a)       Any delays or failures in any systems used by the Society, the ELM or you to transmit e-mails or postal correspondence.

b)      Any failure in any software or other systems used by the Society or the ELM for the administration of the Lottery.

c)       Any delays or failures in the banking system used by the Society or you.

d)      The inability to award a prize due to:

o   any errors or omissions in the data provided.

o   the Player not able to prove that they have met the criteria specified in these Terms and Conditions.

o   any failure by the Player to update the Society or the ELM with any changes to the contact data provided.

e)      Any refusal by the Society and/or the ELM to accept an individual from signing up to the Lottery, or the cancellation of a Player by the Society and/or the ELM.

f)        Any failure to enter your Chance into a draw.

g)       Any event beyond the reasonable control of either the Society and/or the ELM.

h)      Any loss or damage incurred by a Player in connection with their entry to the Lottery, chance of winning a prize or use of any prize.

8.    Self-Exclusion

8.1.      The Lottery is intended to be a fun way to support the Society’s charitable aims and the vital work it does.  If you feel that you have a problem with gambling and wish to be self-excluded from the Lottery, please telephone 0330 002 0285 to speak to a member of our team.

8.2.      You will be opted out from the Lottery for a minimum period of 6 months.

8.3.      During your self-exclusion your direct debit will be cancelled, and any funds held on your behalf will be returned to you.

8.4.      If you wish to opt back into the Lottery after the minimum period of self-exclusion, you will need to telephone 0330 002 0285 to re-enable your account.

8.5.      You will also be opted out of all marketing material during the self-exclusion period to ensure you are not sent any gambling related marketing material during this period.

9.    Complaints

9.1.      Complaints will be handled in line with the Society’s Complaints and Disputes Procedure. Complaints that cannot be resolved by Society or its ELM will be escalated to a third-party Alternative Dispute Resolution entity approved by the Gambling Commission, such as IBAS.

10. Privacy

10.1.  The Society is committed to protecting the privacy of Players and will use your personal information for the purposes of administering the Lottery as described in the Privacy Policy.
